Illinois State Plan and Federal OSHA Standards

Illinois’ State Plan adopts key standards from Federal OSHA jurisdiction, including:

  • Construction standards (29 CFR 1926)

  • Maritime standards (29 CFR 1915)

  • General industry standards (29 CFR 1910)

The Illinois Department of Labor (IDOL) oversees all site inspections, enforcement of standards, issuance of penalties, and handling of appeals through Illinois OSHA. However, Illinois OSHA enforces distinct recordkeeping requirements that all state and local government employees and employers must follow. Since the private sector falls outside the scope of Illinois OSHA, it remains under Federal OSHA jurisdiction.

While Federal OSHA regulates private sector workplaces, Illinois OSHA is responsible for public sector compliance. Despite this division, the construction, general industry, and shipyard standards remain consistent across both jurisdictions, requiring employees and employers to adhere to the same safety rules.

Illinois OSHA also maintains specific recordkeeping protocols and provides certain exceptions within its regulations.

Although OSHA does not mandate training, it strongly encourages employers to provide job-specific safety training. Entry-level workers are recommended to complete the OSHA 10-Hour course, while supervisory personnel are encouraged to take the OSHA 30-Hour training.
