Kentucky is authorized to implement and enforce its own State Plan, as OSHA allows states to establish plans that meet or exceed federal OSHA standards. The Kentucky Occupational Safety and Health (Kentucky OSH) Division of Compliance is the regulatory body responsible for managing the State Plan. Oversight of the Kentucky OSH Division Board is provided by the Kentucky Labor Cabinet.
Kentucky’s State Plan covers certain employees in both commercial businesses and the public sector. While Federal OSHA Standards are incorporated within Kentucky’s State Plan, Federal OSHA jurisdiction requires employees to receive job-specific training based on applicable standards.
Although most employees in Kentucky fall under the jurisdiction of the Commonwealth and the Kentucky OSH Division Board, which adopts Federal OSHA Standards through Chapter 2 of the 803 Kentucky Administrative Regulations (KAR) referencing 29 CFR, these employees receive training equivalent to that required under Federal OSHA.

OSHA generally recommends, rather than mandates, that employees complete training relevant to their job roles. Since OSHA training courses cover a broad range of site safety topics, OSHA advises workers to complete the OSHA 10 Hour and OSHA 30 Hour courses.
Despite Kentucky having a State Plan, some workers remain under federal OSHA jurisdiction, including:
Employees hired under federal employment policies
U.S. Postal Service personnel and private USPS contractors
Private maritime industry employees
Workers employed at federally controlled facilities such as Tennessee Valley Authority sites and military installations
Certain agricultural workers
Aircraft workers engaged in operational duties
Any activities, contractors, or employees outside the regulatory authority of the Kentucky OSH Division
